Jan 20, 2018 · Informer privilege is a common law rule that protects the identity of an informer in court and acts as a “complete and total bar” on any disclosure of all information that might reveal the informant’s identity ( Crime Stoppers , para 10).
Informer privilege is a non-discretionary rule which binds the police, Crown and members of the judiciary. Crown counsel cannot waive the privilege without the consent of the informer. Once it is established that the privilege exists, the court is bound to apply the rule.
A form of privilege protecting the identity of those who provide information confidentially to the police with regard to an offence. Informer privilege overrides the Crown’s obligation of disclosure to an accused, but is subject to the innocence at stake exception.
